Terms of Service

Effective date: October 27, 2026

1. About Oakmont Planner

Oakmont Planner is AI-assisted hospitality and event planning software operated by Pierson Creative Group LLC. It helps prepare menu directions, preliminary estimates, service plans and operator-ready proposals.

These terms describe the service and responsibilities for its use. Features depend on their configuration and account status. Accepting these terms does not confirm an event booking or create a hospitality-services contract between a prospect and an operator.

2. Accounts and authorized use

Use an operator account only if you are authorized to represent the relevant business. Keep access credentials private, use your assigned workspace and do not attempt to access another operator’s records or bypass access controls.

Provide accurate information and use the service lawfully. Do not submit malicious content, interfere with the service or use it to infringe another person’s rights. Notify the service operator of suspected unauthorized account access at support@oakmontplanner.com.

3. AI assistance and preliminary outputs

AI-assisted processing can interpret event descriptions, extract operator source material and draft or revise plans. Outputs can be incomplete, inaccurate or unsuitable for a particular event. Review the underlying source material and verify important details before relying on an output or sharing it with a customer.

A generated menu, estimate, service plan or proposal is a planning aid. It is not an automatic approval, a guarantee of feasibility, a confirmed reservation or a binding offer from an operator. Operator review remains necessary even when the software labels a record approved or active for a particular planning purpose.

4. Operators retain decision authority

Operators retain responsibility for menu decisions, including ingredients, substitutions, portions and suitability for the event.

Operators retain responsibility for pricing, costs, taxes, fees and the accuracy of estimates or final quotes. Software-generated amounts do not establish final selling prices.

Operators retain responsibility for food safety, preparation, handling, storage, service procedures and applicable requirements. Oakmont does not replace professional food-safety judgment.

Operators retain responsibility for reviewing allergies and dietary requirements directly with customers and assessing ingredients, preparation and cross-contact risks. AI output is not an allergen-free or dietary-safety guarantee.

Operators retain responsibility for availability, staffing, venue feasibility and their ability to deliver the proposed event.

Operators retain responsibility for commercial commitments, customer communications, final proposals, bookings and any agreement to provide hospitality services. Those commitments must be confirmed by the operator; Oakmont’s planning output alone does not create them.

5. Submitted material and customer information

Submit only information and source material you are authorized to provide and have processed for the requested workflow. This includes customer information, menus, PDFs, images and website content. Do not assume that a publicly accessible website gives you unrestricted rights to its contents.

Event planning may include dietary and allergy information. Limit it to what is relevant, avoid unnecessary sensitive details and obtain any permissions required to submit information about other people.

The service processes submitted material through its implemented storage, AI and transactional email workflows as described in the Privacy Policy. Operators remain responsible for their own customer notices and for handling information outside Oakmont.

6. Service dependencies and limitations

Configured workflows depend on services including Clerk for authentication, Neon for database storage, OpenAI for AI processing and Resend for transactional email, with Vercel hosting configuration. Availability and delivery can be affected by these dependencies or by incomplete configuration.

Saving a request is different from delivering an email. A delivery status or generated proposal does not confirm that an operator has accepted an event. Verify important communications and commitments directly.

7. Payments and subscriptions

Oakmont uses Stripe-hosted checkout to process paid subscriptions and Founding Partner Pilot purchases. The selected price, billing cadence and plan capacity are presented before the customer continues to Stripe.

Standard paid subscriptions are monthly and automatically renew until canceled. Founding Partner Pilots are one-time purchases for a 60-day pilot period and do not automatically renew.

Subscription customers can manage payment details and cancellation through the Oakmont billing portal.

Customers may cancel at any time. Cancellation takes effect at the end of the current paid billing period.

Fees are generally non-refundable once a billing period begins, except where required by law or at the discretion of Oakmont / Pierson Creative Group LLC.

8. Governing law, disputes and liability

These terms are governed by Arizona law. Venue for disputes is Maricopa County, Arizona, subject to applicable law.

These terms do not require arbitration.

Subject to applicable law and final legal review, the liability of Oakmont / Pierson Creative Group LLC is capped at the fees paid to Oakmont during the preceding 12 months.

No indemnity obligation is created by these Terms unless separately agreed in writing.

Nothing in these terms is intended to waive rights that cannot lawfully be waived.

9. Contact and final review

For privacy, legal or support inquiries about Oakmont Planner, contact Pierson Creative Group LLC at support@oakmontplanner.com.

Customers must affirmatively accept these Terms and acknowledge the Privacy Policy before Oakmont creates a Stripe Checkout session. Oakmont records the Terms version and acceptance timestamp with the Checkout record.

For cancellation, billing or refund questions, use the Oakmont billing portal when available or contact support@oakmontplanner.com. Subscription access continues through the paid billing period when cancellation is scheduled for period end; access is subject to the account’s current billing state.

Material changes to these Terms will be reflected in an updated version and effective date, with any notice or agreement required by applicable law. These Terms do not replace a separately agreed operator-customer event contract.
